Today (14 January 2015), the Constitutional Court of Austria has ruled that same-sex couples have the same rights to adopt children as heterosexual couples.
Chief Judge Gerhart Holzinger has said that there is ‘no objective argument for a differing rule based solely on sexual orientation’. Previously, same-sex partners could adopt a child only if one of the partners was the child’s biological parent.
Holzinger also said that the restrictions on adoption previously placed on same-sex couples violate the anti-discrimination statues of the European Human Rights Convention.
Same-sex couples cannot marry in Austria. Since 2010 the government has offered formal recognition of registered partnerships.
